Previously, the driver remained registered even when the hardware was shutdown. That causes the driver to return -ENODEV if the b43 device is IFF_DOWN. Updated specs do not mention 0 value, but comparing to old ones you can notice lineral relation between PHY clock speed and band width. So it makes sense for 0x0 value to be 10 MHz band width. All drivers will drop frames if they fail to TX the frame, and they must also properly manage the queues (if they didn't, mac80211 would already warn). Removing the ability for drivers to return a BUSY value also allows significant cleanups of the TX TX handling code in mac80211.
